These Newsletter Terms & Conditions ("Terms") govern the provision of the free email newsletter service ("Newsletter") offered by WSHOP Wiktoria Jarzyna, operating under the business name YourMomentJournal, with its registered/business address at Diamentowa 26, 10-698 Olsztyn, Poland ("we", "us", "our").

By subscribing to the Newsletter, you agree to these Terms.

1. What Is the Newsletter?

The Newsletter is a free electronic service through which we send subscribers communications relating to YourMomentJournal, our products and our activities.

Newsletter content may include:

information about new products;
product launches and announcements;
promotions and discounts;
special offers;
information about free resources;
updates concerning our brand and products;
selected informational or inspirational content related to our products;
other marketing or commercial information relating to our business.

The Newsletter may be sent at varying intervals. We do not guarantee a particular frequency or number of messages.

2. Free Digital Resources

From time to time, we may offer a free digital resource as an incentive to subscribe to the Newsletter.

For example, we may offer a PDF with a journal page/pages.

The specific free resource offered may change from time to time.

The Freebie is provided in digital format and is intended for personal, non-commercial use unless we expressly state otherwise.

The Freebie is not a separate paid product under these Terms and is provided in connection with the relevant Newsletter sign-up offer.

We may change, replace or discontinue a particular Freebie offer at any time, subject to applicable law.

3. Eligibility

The Newsletter is intended for individuals aged 18 or older.

By subscribing to the Newsletter, you confirm that you are at least 18 years old.

We do not knowingly direct the Newsletter or Freebie offers to individuals under 18.

If we become aware that an individual under 18 has subscribed without an appropriate legal basis, we may terminate the subscription and take reasonable steps to delete the relevant personal data, subject to applicable law.

4. Subscription

To subscribe to the Newsletter, you must:

provide a valid email address through our sign-up form;
provide the required consent to marketing communications, where applicable; and
complete the double opt-in confirmation process, where enabled.

Submitting the form does not by itself create an active Newsletter subscription where double opt-in is used.

The Newsletter subscription becomes active once the required confirmation has been completed.

5. Marketing Consent

During registration, you will be asked to actively consent to receiving marketing emails and commercial information from YourMomentJournal.

Such communications may include information about:

new products;
product launches;
promotions;
discounts;
special offers;
free resources;
other products, services and activities offered by us.

Where applicable law requires prior consent, we will not send such communications without the required consent.

You may withdraw your consent at any time.

Withdrawal of consent does not affect the lawfulness of processing that took place before the withdrawal.

6. Double Opt-In

We use a double opt-in process to confirm that the email address submitted to our Newsletter form was intentionally provided.

After submitting the form, you may receive a confirmation email containing a link or button to confirm your subscription.

You must complete the confirmation process to become an active Newsletter subscriber.

If you do not confirm your subscription, the Newsletter will not be activated.

Where the relevant Freebie is delivered after confirmation, access to the Freebie will be provided after the subscription has been confirmed.

7. Delivery of the Freebie

Where a Freebie is offered, it may be delivered:

by email;
through a confirmation or thank-you page;
through another digital delivery method made available through our Newsletter system.

The method of delivery may vary depending on the particular offer and technical setup.

8. Intellectual Property

The original content created by YourMomentJournal and included in the Freebie, including original text, designs, layouts, graphics, illustrations and other original materials, is protected by applicable intellectual property laws.

Unless we expressly permit otherwise, you may use the Freebie for your personal, non-commercial purposes only.

You may not, without our prior written permission:

resell the Freebie;
sublicense the Freebie;
redistribute the Freebie to the public;
upload the Freebie to file-sharing websites or marketplaces for redistribution;
claim the Freebie or its contents as your own;
remove copyright or ownership notices;
use the Freebie to create or distribute a competing commercial product.

Nothing in these Terms transfers ownership of our intellectual property to you.

9. Technical Requirements

To use the Newsletter, you need:

a valid email address;
Internet access;
a device capable of accessing email;
an email application or webmail service capable of displaying the messages we send.

You are responsible for maintaining these technical requirements.

Newsletter delivery may be affected by email-provider filtering, spam filters, technical failures, network interruptions or other circumstances outside our reasonable control.

10. Free Nature of the Newsletter

The Newsletter is provided free of charge.

Subscribing to the Newsletter does not require you to purchase any of our paid products.

Any purchase of our digital products is governed by the terms applicable to the relevant transaction and/or sales platform, including Etsy, where applicable.

These Terms do not govern the sale of paid digital products.

11. Unsubscribe and Termination by the Subscriber

You may terminate your Newsletter subscription at any time and free of charge.

You can unsubscribe by:

clicking the unsubscribe link in a Newsletter email; or
contacting us at [email protected]

Once your unsubscribe request has been processed, we will stop sending you future marketing communications, subject to any limited processing necessary to maintain an opt-out or suppression record or comply with applicable law.

Unsubscribing from the Newsletter does not necessarily result in immediate deletion of all personal data.

12. Termination or Suspension by Us

We may suspend or terminate the Newsletter where reasonably necessary, including:

for technical or security reasons;
where required by law;
where continued provision of the Newsletter is no longer reasonably feasible;
where we discontinue the Newsletter;
where a subscriber materially violates these Terms.

Where reasonably possible, we will provide appropriate notice before permanently discontinuing the Newsletter.

13. Prohibited Use

You must not use the Newsletter or Freebie unlawfully or in a way that infringes the rights of others.

In particular, you must not:

provide another person's email address without authorization;
interfere with the operation or security of the Newsletter;
use Newsletter content or Freebie materials in breach of intellectual property rights;
redistribute the Freebie in breach of these Terms;
use the Newsletter or Freebie for fraudulent or unlawful purposes.

14. Complaints

If you have a complaint concerning the Newsletter or the delivery of the Freebie, you may contact us at:

Where possible, a complaint should include:

the email address used for the subscription;
a description of the problem;
the date on which the problem occurred;
the solution you are requesting, where applicable.

We will review complaints and respond within a reasonable time and within any mandatory period required by applicable law.

Nothing in this section limits any mandatory rights you may have under applicable law.

15. Privacy and Personal Data

Personal data collected in connection with the Newsletter is processed in accordance with our Privacy Policy.

16. MailerLite

We use MailerLite as our Newsletter and email marketing service provider and may use its landing page, forms, automation, subscriber management and digital delivery functionality.

MailerLite may process subscriber personal data on our behalf in accordance with the applicable data processing arrangements.

17. Commercial Communications

Newsletter messages may contain commercial information and direct marketing communications.

Such communications will be sent and presented in accordance with applicable law.

We will not knowingly send marketing communications where the required legal consent has not been obtained.

18. Newsletter Content

We make reasonable efforts to ensure that Newsletter content is accurate and up to date.

However, Newsletter content may contain general information about our products, services or activities and is provided for informational and marketing purposes.

We do not guarantee that all information will remain current after an email has been sent.

Prices, availability, promotions and offers may change and are subject to any specific terms communicated with the relevant offer.

19. No Guarantee of Delivery

We do not guarantee that every Newsletter email will reach your inbox.

Messages may be blocked, delayed or filtered by email providers or other technical systems beyond our reasonable control.

You are responsible for ensuring that our emails are not blocked or automatically filtered into a spam or junk folder.

20. Limitation of Liability

We are not responsible for temporary unavailability, delays or failures of the Newsletter caused by circumstances beyond our reasonable control, including failures of third-party email providers, hosting providers, Internet infrastructure or other external systems.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

Nothing in these Terms limits mandatory consumer or other statutory rights that apply to you.

21. Changes to the Newsletter and These Terms

We may modify the Newsletter, its content, delivery method or Freebie where reasonably necessary, including due to changes in our business, technology, services or applicable law.

We may also update these Terms from time to time.

22. Governing Law and Mandatory Rights

These Terms are governed by the laws of Poland, subject to any mandatory provisions of law that apply to you based on your place of residence.

If you are a consumer residing in another country and mandatory consumer protection laws of that country apply to you, those mandatory rights remain unaffected.

Nothing in these Terms is intended to deprive you of any protection that cannot lawfully be excluded under applicable law.

23. Severability

If any provision of these Terms is held to be invalid, unlawful or unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law.

Where legally possible, the invalid or unenforceable provision shall be replaced or interpreted so as to most closely reflect its original purpose.
